A homeless man agreed this week to a cash settlement of a lawsuit claiming that a McDonald's employee whacked him in the head with a "wet floor" sign after he complained about his burned Sausage McMuffin.
Attorneys for Kevin Pearce and the Northeast Portland restaurant wouldn't say how much money exchanged hands. Pearce had sought $48,000.
A video of the May 2012 confrontation, released to The Oregonian/OregonLive by Peace's lawyer, shows a wild scene.
The video doesn't have audio, but shows Pearce walking up to the front counter of the restaurant at 1520 N.E. Grand Avenue to complain to employee Esgar Lopez Coy that the $2 biscuit was overcooked.
Pearce's attorney said his client explained that he had no teeth and couldn't chew the charred McMuffin.
"In lieu of replacement or refund, defendant Coy began issuing verbal insults, laced with expletives, at plaintiff," stated the suit, filed last March in Multnomah County Circuit Court. "These insults were based upon plaintiff's socio-economic status and homelessness." READ MORE
